Trademark Thoughts with Tiffany™: Search Before You Brand

You’ve picked the perfect name. The logo is designed, the domain is registered, and the Instagram handle is claimed. Then a cease-and-desist letter arrives, or the USPTO refuses your application because of a similar mark. Now you’re paying to rebrand, and every dollar and hour you invested in the name you fell in love with is gone.

Here’s what you should know: before you commit to a name, conduct a trademark clearance search. A comprehensive search looks for existing and potential marks taht could conflict with yours.

Is a Google search enough?

It’s a good place to start to see what all is out there. However, your search should cover federal and state trademark records, unregistered “common law” uses, business names, domain names, and social media. A comprehensive search should cover all of that because a brand can have legal rights without ever having filed anything.

What if I search and there’s no identical name?

It’s about similarity, not just having identical names. The USPTO looks at the likelihood of confusion in the marketplace when reviewing applications. Marks that look alike, sound alike, or convey a similar meaning can pose a conflict, especially when the goods or services are related. Your name doesn’t have to exactly match someone else’s to cause a problem.

When should I get a search done?

Timing matters. If you haven’t launched yet, then now is the perfect time to have a comprehensive search done. The cheapest moment to change a name or logo is before launch. Before you print packaging, publish a book with a series title, or build a following, a name change costs nearly nothing. After, it can cost you thousands of dollars.

What do I get from a professional review?

With VirtuEdge Legal, you get a search report, an opinion letter with our licensed attorney’s risk assessment, and why the risk is low, moderate, or high. That lets you make an educated business decision, rather than hoping for the best.

Clearance isn’t a guarantee, since no search can find everything and outcomes depend on the facts. But it dramatically reduces the odds of an expensive surprise.

Thinking about protecting your brand?

VirtuEdge Legal offers comprehensive trademark packages that includes a search report, an opinion letter with a risk assessment, and more so you know where you stand before investing further in your brand.
