“How much does it cost to trademark my name or logo?” is usually the first question potential new clients ask. The honest answer is: it depends on what you’re protecting and how smoothly is goes.

USPTO filing fees.

The government charges a per-class fee, meaning that the cost multiplies if you’re registering in multiple categories of goods or services (say, both clothing and online retail services). These fees change periodically, so always confirm the current amount on uspto.gov before budgeting. (As of Friday, September 25th, 2026, the current fee is $350 for one mark in one class.)

Attorney fees.

Many trademark attorneys offer flat fees for standard applications, which makes budgeting easier than hourly billing. This typically covers the search, risk assessment, filing, and responding to routine correspondence. Each law firm has different fees for what’s covered, so always review your engagement letter and ask for clarification if needed.

Search costs.

A basic search may be bundled into your flat fee. A deeper, professional-grade search covering common law and state records can be a separate line item, but it’s usually worth it for a brand you plan to build seriously.

Office action responses.

If the USPTO examiner raises issues with your application, responding may cost more, especially if it requires a detailed legal argument rather than a simple fix.

Maintenance filings.

Between years five and six, and again at year ten, you’ll need to file proof of continued use, each with its own fee.

  • Applying in multiple classes

  • A crowded name that invites office actions

  • Applying based on “intent to use” rather than actual use (which requires an extra filing fee later)

  • Opposition from another company
