The Sword & Shield Process:
Your brand deserves more than hope. It deserves a strategy.
Assess Your Armor. We’ll chat for approximately 30 minutes about where you’re at, how you’re using your mark, and where you plan to go with your brand.
Get Started. An engagement letter describing our partnership will be sent for you to e-sign, as well as an invoice. Once the engagement letter is signed and returned and the invoice is paid, I’ll begin work.
Search. I’ll complete a comprehensive search of the mark(s) you want to protect.
Understand Your Risk. After completing a comprehensive search, I’ll draft an opinion letter describing whether your mark is high-risk, moderate-risk, or low-risk — so you can decide how you’d like to move forward.
Choose Your Strategy. Once you've decided how to move forward based on the risk level, I'll draft your application. If your initial mark comes back high-risk, you’ll get a free search and opinion letter for a different mark of your choosing — as long as you provide the second mark within two weeks of receiving the original opinion letter.
Review. I’ll send your application to you for your review and signature.
Raise Your Shield. After you’ve reviewed and signed your application, I’ll submit it to the USPTO on your behalf.
Hold the Line. The USPTO has a review time that varies, but most applications are not reviewed until at least six months after submission.
